Ruff Ruff, Perry, Bond, Cobb & Wade 200 Attorneys Building Charlotte, North Carolina Re: Swann vs. Charlotte-Mecklenburg Board of Education Dear Tom: I refer to your letter of July 14 and our conversation today with respect to school bonds and current litigation. In this letter, I shall attempt to point out to you the pertinent pleadings and orders respecting restraining school construction. On September 6, 1968, the plaintiffs filed a motion for further relief and sought the following relief: "... The Court permanently enjoined defendant: (3) To cease'planning and constructing schools, additions to schools and school facilities on the basis of race and color. In this connection, that the defendant be enjoined to present to the Court, with copies being served upon plaintiffs, a report of any planned construction, addition, alteration or closing; . . . " The District Court in its order of April 23, 19 69, did not enjoin the construction of schools but suggested that the "School Board refrain from acquiescing in locating schools in predominantly black or white areas.
