Bethune, County Attorney July 13, 1994 , (1) Procedure for filling vacancies on the Board of Commissioners (2) Procedure for filling vacancies among party nominees occurring after nomination and before election Because of the untimely death of Commissioner Robert Walton, I am sure you will all be receiving questions on both of the above-referenced matters. I am writing to provide you with sufficient information to enable you to accurately answer these questions. ISSUES (1) What procedure is to be followed to~ftlljhe vacancy on the Board of Commissioners created by the death of Commissioner Robert Walton? (2) What procedure is to be followed to Fill the vacancy on the November ballot created by the death of Commissioner Robert Walton? OPINION (1) If a vacancy occurs on the Board of Commissioners, the remaining members of the Board shall appoint a qualified person to fill the vacancy. The appointment to fill the vacancy is for the remainder of the unexpired term. To be eligible for appointment to fill a vacancy, the person must be a member of the same political party as the person being replaced, and be a resident of the same district as the member being replaced, when the County is divided into electoral districts. When the member who vacated the seat was elected as a nominee of a political party, the Board of Commissioners shall consult the County Executive Committee of the appropriate political party before filling the vacancy, and shall appoint the person recommended by the County Executive Committee if the party makes a recommendation within 30 days of the
